Rules for using matcher.band

1. Provider and Scope

matcher.band is operated by Michael Wiese, Asternweg 14, 47906 Kempen, Germany ("we"). Further details are in the imprint.

These terms apply to the use of the matcher.band website and app (together, the "platform"). By registering, you agree to them.

This translation is provided for convenience; the German version is legally binding.

2. Our Service

The platform helps musicians and bands find each other: you can publish profiles and announcements, search for fellow musicians, receive suggestions, and exchange messages.

Use is free of charge. There is no entitlement to any particular availability or feature; we may develop the platform further and change or discontinue features.

We only provide the platform. Arrangements, band projects, and contracts are made solely between users; we are not a party to them.

3. Registration and Minimum Age

  • You must be at least 16 years old to register.
  • Your information must be truthful. Each person may create only one account; band profiles may only be created by members of that band.
  • Keep your password secret. If you suspect someone is misusing your account, change your password and let us know.

4. Your Content

You are responsible for the profiles, announcements, photos, links, and messages you post. Only post content you hold the necessary rights to. You may only publish photos in which other people can be recognized with their consent.

You grant us the simple, royalty-free right to store and display your content on the platform as far as operating it requires. Profiles and announcements are publicly visible (see the privacy policy). This right ends when you delete the content or your account.

5. Code of Conduct

In particular, the following is not allowed on the platform:

  • unlawful, insulting, threatening, discriminatory, pornographic, or violence-glorifying content
  • harassing other users or continuing to message them against their will
  • false identities, fake profiles, or announcements without a genuine purpose
  • advertising, spam, chain letters, or commercial mass outreach
  • automated extraction of other users' content (scraping) or technically disrupting the platform
  • infringing third-party rights, such as copyright, trademark, or personality rights

6. Reports, Moderation, and Suspension

You can report unlawful content and violations of these terms using the report function in the app or by email to info@matcher.band. We review reports promptly and carefully, by people rather than automated systems.

In case of violations, we may remove or hide content, temporarily suspend your account, or terminate it, taking into account the severity and frequency of the violation. We will inform you of such a decision and its reasons as far as legally permitted. You can object to the decision by email; we will then review it again.

7. Meeting Other Users

We do not verify users' identities. Be careful when meeting people you got to know through the platform: meet in public places or in rehearsal rooms with several people first, and do not share payment details or make advance payments.

8. Termination

You can delete your account in the app at any time, which ends the user agreement. We may terminate the user agreement with two weeks' notice, or without notice in case of serious violations of these terms.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations, meaning obligations whose fulfillment makes using the platform possible in the first place and on whose observance you may regularly rely. In that case, liability is limited to the foreseeable damage typical for this kind of agreement. Otherwise, liability for slight negligence is excluded.

We are not responsible for other users' content or for arrangements between users.

10. Privacy

How we process your data is explained in our privacy policy.

11. Changes to These Terms

We may change these terms when the platform or the legal situation changes. We will inform you of significant changes at least two weeks before they take effect, by email or in the app. If you do not agree with the changes, you can delete your account before then.

12. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

Should any provision of these terms be invalid, the remaining provisions remain in effect.
